This paper expatiates on the connotations of the independent administrative power and the legal bases, necessity and rationality for colleges and universities exercise independent administrative power, analyzes the meanings and contents of students＇ education right, the causes for the conflicts between the independent administrative power and students＇ education right, and points out the approaches to equilibrate them.
