On the Value of Human Rights Safeguard in the Policy of Imprisonment Penalty

人权保障理念的兴起是近代西方国家监禁刑政策发生转变的动因之一。国际社会有关监禁刑政策的一系列规定均体现了罪犯人权保障的价值取向。我国的监禁刑政策在刑罚目的、手段以及罪犯享有的权利等方面也在相当程度上体现了对罪犯人权保障的价值取向。但我国的罪犯人权保障制度仍存在着诸多的不足,需要我们在实践中不断加以完善和发展。

The emergence of the human rights safeguard was one of the reasons for which the policy of imprisonment penalty has changed in neoteric occidental countries. A series of international regulations embodied the value of the protection of the human rights of the criminals. The policy of imprisonment penalty in China which contains penal aim, means and rights expressed the value orientation of protection of the human rights of the criminals to a great extent. However the deficiency still exists in Chinese system and needs to be continuously ameliorated in practice.
