警检关系之改造

On the Reform of the Police-Procuratorate Relation

我国目前警检之间是在检察监督基础上的分工负责、互相配合、互相制约关系,不仅不利于刑事追诉权准确而高效地行使,而且也不利于其合法而有序地运行。解决我国现有警检关系面临的问题,不宜采用警检一体化,而应在坚持现有警检模式的基础上,加强警察对检察的配合及其相互间的沟通并强化检察监督。

Chinese current police-prosecutors relation is that of dividing their functions, each taking responsibility for its own work, coordinating their efforts and restricting each other based on the procuratorial supervision, which makes against not only correct and effective exertion of criminal prosecution power, hut also its legitimate and regular function. The integration of police and procuratorate should not be adopted to resolve the problems within current police-procuratorate relation ; however the coordination of the police with the procuratorate and the communication between them should he enhanced and the procuratorial supervision should he strengthened with persevering in present situation.
