完善我国宪法救济制度的思考

Thinking on the Improvement of the Remedy System of Constitution of Our Country

宪法确认的公民基本权利主要依赖于法律的具体化而得以保障。但当规范性文件与宪法抵触时及当宪法权利没有被具体化而公权力作出的具体行为侵害公民基本权利时,就需要通过宪法救济制度来保障公民的宪法权利。我国现有的宪法救济制度存在着一定的缺陷,有待进一步完善。

The citizen＇s basic right that affirms by constitution be guaranteed mainly by the law which concretizes the basic right. When norm documents contradict with constitution and constitution right is not concretized but public authority makes encroaches on citizen basic right, it＇ s need to come to ensure constitution right by the constitution remedy system. Now the constitution remedy system of our country has certain defects, it need further perfect.
