经济视角下传统中国“无讼”现象的分析——另一种法文化的思考

An Economic Analysis of Chinese Traditional Phenomenon of “Wu Su”,or People Chose Not to Go to Law:Considering Legal Culture from Another Aspect

本文主要试图对中国传统的“无讼”现象进行经济方面的分析。笔者认为,民众经济方面的负担、国家官员们的灰色收入正是导致这一现象产生的重要原因,而终极原因是小农经济的社会基础和对王权保护的制度。

This article aims to analyze the phenomenon of ＂Wu Su＂ in traditional China from economic perspective.＂Wu Su＂ mainly results from state officers＇ gray income and the economic burden to litigants. However, the most important and the most decisive reasons are the social basis of the small-scale farming economy and the protection system to the imperial authority.
