全球化时代中国废除死刑的发展路径

Approaches to the Abolition of the Death Penalty in China at the Time of Globalization

死刑废除是由众多原因导致的复杂社会现象,其成就并非一朝一夕之功。我国能否废除死刑与今后社会转型中的工具本位转换、政府责任主导、文化守成改造和学术取向转型呈现出密切的正相关性。详细分析我国死刑废除的发展路径的研究表明,我国死刑废除的切入点应当是在全面破除“工具本位”变革路径的基础上,强化主动型政府责任的承担,全面更新原有重刑主义死刑文化,并实现一定的刑法学术研究创新。而不宜就事论事地照搬西方或人云亦云地顺应国际潮流,空谈死刑废除问题。

The abolition of the death penalty is a complicated social phenomenon influenced by various factors and therefore cannot be achieved overnight. The abolition of the death penalty in China is closely related to the abandonment instrumentalism of criminal punishment, the strengthening of the responsibilities of the government, the reform of cultural conservatism, and the change of academic trend in the field of criminal law. A careful analysis of the approaches to the abolition of the death penalty in China shows that China should, on the basis of abandoning of instrumentalism in criminal law, strengthen the positive responsibilities of the government, reform the culture of emphasizing heavy criminal punishment, and encourage innovation in criminal law research, rather than blindly copying the western practice or following the international trends.
