Solutions to the Problem of Compensation for Transboundary Pollution Damage: A Suppositive Case Study of the Songhua River Pollution Accident

假定松花江污染事故造成了跨界污染损害,就有了如何对待跨界污染损害赔偿的问题。在这个问题上,有国家赔偿、国际民事赔偿以及外交谈判和协商三种基本的方式。基于法律解决国家赔偿和国际民事赔偿的选择不是最佳的,基于外交解决的谈判与协商应是中俄双方应当采取的妥善的解决办法。

Had the Songhua River pollution accident led to transboundary pollution damage, the problem would have appeared of how to compensate for the damage, to which three solutions exists ： state compensation, international civil compensation and diplomatic negotiation and agreement. This article examines the three possibilities and determines that negotiation and consultation is the best method that would have been adopted by both the Chinese and Russian governments.
