经济立法中的法律移植和本土资源

对于经济立法,我们是应该采取法律移植的方式还是立足于本土资源让其在本国国内自发形成?这个问题在经济法学界一直存在着争论。究竟在经济立法中,法律移植和本土资源的关系如何?本文通过分析我国经济法与西方经济法的共性及中国经济法所具有的个性,试图对这些问题进行探讨。

As far as economic legislation is concerned, should we adopt law transplantation or let it interiorly come into being spontaneously on the basis of natural resources？ It has been disputed in economic law. And what is the relationship between law transplantation and natural resources in law legislation？ This thesis discusses all the above by analyzing the general characters between economic law in china and western countries and the specific characters of Chinese one.
