我国风景名胜区经营权转让研究评述

A Study Summary of the Operation Right Transformation of Scenic Spots in Mainland

自1998年以来,有关风景名胜区经营权转让的研究在我国逐步展开。从最初的经营权能否转让和景区经营企业能否上市之争,到经营权转让的制度安排、模式构建和经营权转让后的效应评价,研究内容不断丰富,但仍存在一些缺陷和不足。本文旨在对我国风景名胜区经营权转让的相关文献进行梳理,对目前学术界主要关注和研究的几个方面加以总结、分析、评述,并指出研究中的主要缺陷和不足,尝试为后续的深入研究提供思考方向。

Since 1998, the relative study of the transformation of operation right of scenic spots has been gradually carried out. The study is witnessed such a course： originally, the focus is mainly on whether the operation right of scenic spots can be transformed and whether the operating corporation can be listed, then attention is gradually paid to other aspects such as the arrangement of transformation institution, the establishment of transformation mode and the effect evaluation of transformation, reflecting the scholars＇ understanding on this issue is increasingly being mature and rational. However, there still existed several defects that should be emphasized. This paper is expected to summarize, analyze and evaluate the current study on this issue, find those defects, bring forward a definite picture of the structure, method and level of current study and simultaneously, hoping it can shed enlightenment for those who want to study on this issue comprehensively and thoroughly.
