Theoretical Contribution of Humanist Law to Modern China′s Jurisprudence

人本法律观是以人为本的科学发展观在法律领域的体现与运用,是发展的马克思主义指导的法学理论体系,是马克思主义法学中国化的重要成果。它对当代中国法学的理论创新主要体现在四个方面:阐明了法律从异化到回归的发展规律;论证了人是法律之本的原理;发展了马克思关于异化的理论——法律的异化与回归;开创了一种新的法学研究方法——人性分析法。

The idea of humanist law is the embodiment and exertion of the views of scientific development and human - centered ideas in the law field. It is the theoretic system of developing Marxist guidance and the great contribution of the Chinese Marxist jurisprudence. It has four innovations： illuminating the regulation of the law＇s development from alienation to return; demonstrating the principle of human as the source of law; developing the theory of Marxist law＇s alienation and return; and initiating a new way to study the law humanist analysis.
