摘要
建筑物区分所有权是物权法中的一项重要制度,关涉到每个公民的切身利益。然而,我国目前对此尚无立法,学界观点亦不一致。文章从建筑物区分所有权概念的界定入手,分析了建筑物区分所有权包含的权利种类,并提出了针对我国社会及立法现实的建筑物区分所有权法的立法模式——“物权法加建筑物区分所有权法”。
The building discriminated property rights are an important system in the reality of laws, and it is related to each citizen's intimate interest. However, there is still no legislation about it in our country, and the viewpoints in the academic circle on the topic are of difference. This paper starts with the definition of the building discriminated property rights, analyzes the various right types it contains, and puts forward the basic legislation mode of the real rights law, which is called law of property and rights and the building discriminated property rights.
