摘要
《中华人民共和国物权法》(以下称《物权法》)在千呼万唤中出台了,这在中国立法上有着里程碑的意义。但欣喜之余却有些微遗憾,就是《物权法》没有规定居住权制度,更勿论对法定居住权进行规范。在物权社会化的世界趋势下,社会公共利益日显重要,而在建立和谐社会的世纪号角声中,弱势群体的保护应该奏出最强之音。因此,我国有必要在广义的物权立法框架中确定法定居住权制度,并使其定义、性质、法律关系的内容在法律上有所反映,从而实现法律保护弱者利益的目的,进一步完善我国物权法体系。
The Real Right Law of PRC has been enacted after long expectations from the mass. It is a milestone in the history of China's legislation. However, there are still some pities besides the reception,of which, there is no confirmation of residential right system, not mention to the legal residential right. In the author's opinion, the public interests have been becoming gradually important with the trend of socialization of the real right in the world. The protection of the underdeveloped group should be emphasized in the symphony during the course of construction of harmonious society in the new century. The Legal Residential Right should be established in the legislation of the real right in a broader sense, with its definition, character and legal relation demonstrated in the law, so as to furnish better relief for the underdeveloped group and improve the system of the real right in China.
