我国商业贿赂法律规制的一般分析

AN ANALYSIS OF THE LAWS GOVERNING COMMERCIAL BRIBERY IN CHINA

商业贿赂目前在我国已达到很严重的程度,几乎存在于每个行业、泛滥于市场的各个角落,甚至成了经济领域交易的“潜规则”,严重破坏了公平竞争的社会主义市场经济秩序,由此衍生出大量腐败,严重影响了政府的廉洁性和公信力。因此,必须加快建立和完善适合我国国情的诚信管理法律制度,实施企业诚信守法提醒制、警示制、公示制,构建社会信用体系和防止商业贿赂的法律体系。

At present, commercial bribery has become rampant throughout China. Its existence in every industry and every corner of the market almost makes it a ＂hidden rule＂. Commercial bribery seriously undermines the principle of fair competition that the socialist market economy advocates. It breeds corruption and damages the honesty and public--trust of the government. Therefore, a law system that curbs commercial bribery has to be developed and matured as fast as possible, which features in honorable government, including reminding and alarming the enterprises to abide by the laws and publicizing those who fail to do so, in order that a social credit system free of commercial bribery can be established.
