摘要
区分所有是现代社会建筑物的主要所有形式。其中,专有部分权属的性质相对单纯,不易产生纠纷。相反,对于共有部分的共有性质则存在多种学术观点,而观点的不同直接影响到对于共有部分权利义务的分担。伴随着《物权法》的出台,对于共有部分性质的规定吸收了优秀的理论成果,并且也具有一定的实践意义和操作可能。
Distinguished ownership is the major form concerning ownership of buildings. The rights of exclusive section are simpler and have less disputes. Conversely, there are many viewpoints on the nature of common section, which concerns sharing rights and obligations. As Property Law passed, the regulations about common section contain outstanding theories and become more practical.
