On the Dualism Mode of Law and Jural Relation——A Survey on the Classical Natural Law Thoughts in Modern Time

本文概要地论述了近代西方古典自然法学家关于法与法律关系的基本学说,指出尽管自由主义的古典自然法学、国家主义的古典自然法学和综合主义的古典自然法学,在自然状态与社会状态、自然法与实在法的概念内涵、基本特征及其相互关系问题上的看法有差别,但是它们都恪守自然法与人类法相区别的唯心主义法学二元论立场,这对西方法学的发展产生了深远的影响。

This paper briefly discusses the basic theory about law and jural relation by western classical natural law expert in modern time. It also points out that liberal natural law, nationalistic natural law and composite natural law have different views on the contents, basic characteristic and interrelation, but they all abide by the mentalistic dualism position in which natural law differs from law of mankind. This theory has far-reaching influence on western law＇s development.
