论中国社会主义新农村建设时期的商法变革——从农村经济市场化引入

On the Reform of Commercial Law During the Construction of China's New Socialist Countryside ——At the Angle of Rural Market-Oriented Economy

中国一直致力于市场化建设事业,农村经济市场化是市场化建设的一部分。显然,农村经济市场化与商事法律制度有着天然的、必然的联系。在建设社会主义新农村时期这种联系尤为明显与重要。在这种联系中具有重要地位的是农村在中国市场经济体系及商事制度的地位问题、农村承包经营户的商事主体问题、关于农村剩余劳动力及农村其他资源的商事客体问题以及农村公益事业的商事运行制度问题等等。这些问题使得我们要重新思考如何变革我们的商事法律制度。

China has continuously devoted to the market construction, one of which is the rural market-oriented economy. Obviously, there is naturally an inevitable relationship between the rural market-oriented economy and the legal system of commercial affairs. This kind of relationship is becoming more obvious and more important during the construction of China＇s new socialist countryside. The status of cotintryside in China＇s market economy system and the commercial system, the issues of commercial subject of the contract management households in the countryside, the issues of commercial object of the surplus labor force and other resources in the countryside, and the commercial running system of the rural public welfare take the first place in this kind relation. All these problems make us reconsider how to make a reform on our legal system of commercial affairs.
