试论我国行政立法的完善——基于成本-效益分析

Preliminary Discuss on the Perfection of Our Country's Administrative Legislation:Based on the Cost-benefit Analysis

我国行政立法规模很大,但法律运行的社会成本高,社会效益不尽如人意。文章运用成本—效益分析法,对立法成本、守法成本、违法成本、执法成本,以及行政立法的效益进行分析,最后提出完善行政立法的有关思路,以期促进“良法”的诞生。

The scale of our country＇s administrative legislation is large, but the social cost of legal performance is very high and the social benefit is ungracious. This paper analyzed the cost of lawmaking, obeying the law, breaking the law, enforcing the law and the benefit of administrative legislation, and put forward the relevant way of thinking to perfect the administrative legislation at last to wish to promote the birth of ＂good law＂.
