论进一步完善探望权制度

On the Perfecting Right of Visitation Again

现行婚姻法中的探望权在立法上仍有瑕疵,从探望权的适用范围、其权利和义务主体以及探望权的中止与强制执行等方面进行初步探讨,以期探望权制度得到进一步完善。

Although the current Law of Marriage has provided legal support to protect the fights of parent who hasn＇ t been bringing up his/her child directly, there are still some flaws in the provisions from the scope of legislation. Accordingly, in expectation of improving the institution of visitation, the writer shall carry on a preliminary discussion about the scope of application, the body of right and obligation, the suspension of execution and compulsory execution of the right of visitation.
