摘要
事实劳动关系是在我国特定劳动法律背景下出现的一个过渡性概念。对事实劳动关系在理论上和实践中进行认定,正确把握其所反映的法律关系的本质,有利于明确适用法律,依法维护劳动者的合法权益。
The actual labor relationship is the transitional concept, which emerged in the special background of legislation on labor relationship. In order to safeguard the legitimate rights and interests of laborers in accordance with the law, it is of great significance to make the actual labor relationship definite in theory and practice.
