试论模糊性语言在法律实践中的运用

On the Use of Indistinct Language in the Practice of Law

精确性的语言在法律语体中的使用普遍得到人们的认知和注重,但模糊性的语言在法律实践中的应用却相当谨慎。法律语言存在着模糊性,但它不应与“含混”、“歧义”混淆,模糊性法律语言在司法实践中的应用,对于法律的完善和司法的可操作性有着重要作用。应加强对这方面理论的研究,并在法律实践中得到重视和正确运用。

The widespread utilization of precise language has received people＇s recognition. But the utilizais quite cautious of indistinct language in law＇s practice. Indistinction is the inherent characteristic of the law. There is indistinction, but never mix it with vague and ambiguity. The utilization of indistinct language plays an important role in the improvement of law and serviceability of judicature. Therefore, we should lay emphasis on the practice in law and correct utilization; also strengthen the researches of relative theories.
