关于环境行政公益诉讼的法律思考

Legal Consideration of Environmental Administrative Public Interests Litigation

经济与社会发展带来的环境问题成为全社会关注的热点。环境公益作为一种公共利益,已经在许多国家的法律中得到了认可和确认。通过对环境行政公益诉讼概念与特点的分析,指出环境行政公益诉讼在我国建立的必要性,并通过对我国现行的行政诉讼法在建立环境行政公益诉讼方面存在的问题进行了分析,提出修改行政诉讼法时应规定环境公益诉讼的有关内容。

With the development of society and economy, environment problem has become the focus of social attention.Some countries＇ law have affirmed to declared the environment as public interest. Through the analysis of concept and feature of environmental administrative public interests litigation, this article points out the necessity of foundation of environmental administrative public interests litigation in China. Some suggestions are put forward to revise Administrative Procedure Law about it.
