通向公平分配之路——论社会保障法律制度中的政府责任

A Road Leading to Equitable Distribution——On Government′s Responsibility under the system of Social Security Laws

对拥有强大力量和极高权威的政府而言,保护社会弱势群体、实现社会财富公平分配是责无旁贷的,这也是各国建立、发展并不断完善社会保障法律制度的宗旨所在。综观世界各国的社会保障法,其中政府责任主要历经了政府全面干预、政府责任削弱、政府责任与市场机制相结合三个阶段的演变。而我国正处于社会转型期,社会保障法律制度也在改革当中,现实中政府面临着重重的责任困境。为达社会财富的公平分配目的,需要努力推进社会保障法律制度的建设,厘清并重构政府责任。

The governments that possess powerful authorities have the obligations to protect the social vulnerable groups and distribute social wealth equitably. In order to achieve such goals, a legal system of social security should be established. China is now in a period of social transition, when the problem of distribution becomes extremely serious. It is urgent for the governments to reconstruct and clarify their responsibilities in the Social Security Law in the future.
