TRIPS协议中商业秘密的竞争法规则及我国相关法制的完善

Rule of Competition Law for Trade Secrets of TRIPS and Improving Relative Rules of China

世界贸易组织《与贸易有关的知识产权协定》从保护“未披露信息”和防止滥用商业秘密权两个方面对于商业秘密的保护作出了规定。从整体上来讲,我国竞争法对商业秘密的规则还不是非常完善,尤其是防止滥用商业秘密权限制竞争方面,立法比较零散,应当从强化商业秘密权的保护和防止商业秘密权滥用两个方面加以改善。

TRIPS have some rules for protection of trade secrets. These rules contain two respects： protection of undisclosed information and prevent of abuse of trade secrets. Chinese competition law have shorts of the rules of protection of trade secrets, especially on prevent of abuse of trade secrets. The main suggestions on perfecting our nation＇s law are focus on protection of trade secrets and prevent of abuse of trade secrets.
