摘要
乞鞫是秦汉时期的一种再审诉讼制度。《张家山汉墓竹简》中的《二年律令》对这一制度作了较为系统的规定,《奏谳书》第17例“黥城旦讲乞鞫案”则展示了一例较为完整的乞鞫案的审判情况。因此,这些简文的出土为了解当时的法律制度提供了非常珍贵的文献资料。
Qiju is a kind of re - appeal procedural system in Qin and Han Dynasties. The Second Year Laws and Decrees in the Inscribed Bamboo Slips discovered from the Tomb of Han Dynasty at Zhangjiashan has prescribed Qiju systematically. The No. 17 case in Zou Yan Documents is a good case about Qiju. So the discovery of the inscribed bamboo slips provides abundant valuable documents for studying the legal system of Qin and Han dynasties.
