北宋前期奏狱复审制度

The Reexamining system of Cases Reported in the Preceding Period of the Northern Song Dynasty

北宋前期形成了严密的奏狱复审制度,凡是地方司法机构不能判决的疑难案件均要上奏朝廷复审,奏狱一般要经过中央司法机构的复审、皇帝敕决、宰相审阅和百官集议等过程。这种严密而复杂的司法复审制度在一定程度上反映了北宋司法体制的成熟。

Strict reexamining system of cases reported was founded during the preceding period of the Northern Song Dynasty. All doubtful and difficult cases, which the local judicial departments could not judge must be reported to central government to reexamine. Generally, as to cases, there must be the process that were reexamination of central judicial departments, personal judgment of emperor, the perusing of Prime Minister and discussion of officials. In a certain extent, the strict and intricate reexamining system reflected the maturity of judicial system of Northern Song.
