文献资源共享与知识产权保护关系辨析

文献资源共享是我国图书馆事业发展的必由之路,也是信息社会的必然选择;但在我国近五十年共享历史发展过程中,因为各种各样的原因,步履艰难,其中知识产权问题,没有明确的法律界定,文献资源共享的“共享性”,和知识产权的“专有性”、“排它性”的矛盾一直困扰我国文献资源共享的步伐,如何在尊重知识产权的前提下,充分地实现文献资源共享,鼓励知识的生产与促进知识传播均衡协调发展,是目前图书馆界学者共同探讨的问题。

Documental resource sharing is a necessary step and choice we should take during the development of our national libraries. However, for various reasons, we met much difficulty during the past 50 years. The reasons mainly include property fight, which lacks law restriction and hinder the step of documental resource sharing. How to make full use of document resources under the premise of property fight respect is a general question among libraries.
