我国经济法基本原则的新思考

Reflection on the Basic Principles of Economic Law of China

经济法基本原则是经济法的一个基本理论问题,一直以来争论不休,本文从经济法的宗旨和本质的角度出发,根据经济法的价值目标和调整方式等特性,将经济法基本原则表述为社会本位原则、国家适度干预原则、弱者保护原则和可持续发展原则,四个原则内在统一、协调一致地作用于我国经济的建设和社会的发展。

The basic principles of Economic Law are a fundamental theory of Economic Law that has been agued for a long time. From the angle of the tenet and the essence of Economic Law, and based on its peculiarity of the value goal and the adjustment way, this paper prescribes the basic principles of Economic Law as society standard principle, moderate interference of the government principle, principle to protect the weak and sustainable development principle. And the four principles united each other, which can play a more important role in the economic construction and the social development.
