代理制度是随着商品经济的发展,逐步发展起来的一项补充民事主体能力不足的代理制度,经过数百年的发展,代理制度已经从最开始的一元的民事代理衍生为二元的民事代理和商事代理并存的局面,代理形式也日益的多样化。比起历史悠久的民事代理,商事代理的“资历”显得相对年轻,作为一定意义的新生事物,很多人对商事代理制度还不甚了解。文章将从民事代理和商事代理的特点出发,通过比较两者的异同来揭开商事代理的神秘面纱。

Agency system is developing with the development of commodity economy, and it has the function of replenishing the lack of civilian ability. Through hundreds of years＇ development, the agency system has turned into two branches which appear to both civilian agency and merchant agency existed. The forms of agency are also diversified. Compared with the civilian agency, the merchant agency has shorter history. As a new born fact, the merchant agency is not well-known. The text will compare the differences of civilian agency and merchant agency, to show the readers the characteristics of civilian agency system and merchant agency system.
