论民事诉讼中自认的正当性

On the Justice of Admission in Civil Procedure Law

文章从自认的属性出发,探讨自认正当性的基础,以期通过程序的设计使我国民事诉讼中的自认更具有正当性,维护司法的权威性。为了保障司法活动的顺利进行,维护当事人的合法权益,同时也将法院从繁重的讼累中解放出来,我国民事诉讼制度应在不断完善的过程中,制定符合我国国情的真实义务原则。

For the character and purpose of civil procedure, admission is possible to be deceitful in the litigation. This article argues the nature of admission, and then probes into its base of justice in order to make admission more justice and uphold legal authority by the design of civil procedure. In order to guarantee judicial proceeding, protect legal interest and lessen the heavy work of court, our civil procedure law should enact the obligation of truthfulness at the minimum limit.
