Discussion on Equipment Contract Character

装备合同作为合同的一种，从保护国家利益出发，应赋予军方一定的特权并应将之法律化，从行政合同的概念和特点上分析，装备合同属于特殊的民事合同的性质，并在最后给出为保护军方权利应采取的措施。

As a sort of contract,equipment contract should gave army a privilege which should be codification from the view of protecting the interest of nation. The paper analyses the concept and the character of executive-contract, and then gives a conclusion that equipment contract is a special civilcontract. In the end, the paper proposes suggestions on how to protect the legal right of army.
