摘要
作为教育行政部门、学校与教师权利和义务的重要平衡器,集体谈判至今在美国甚为流行。它顺应了教育民主化的潮流,对于维护教师权益和确保学校正常的教育教学秩序起到了重要作用。由于美国实行地方分权的教育管理体制,集体谈判的内容、程序和方法等方面各州不尽相同,但都受制于美国联邦和各州的宪法与法律。
Teachers' collective bargaining,which can balance the rights and obligations between the educational administration authorities,schools and teachers,is prevailing in America today. It helps to promote educational democracy and protect teachers' rights and en-sure normal educational order. As a result of educational administration system of decentralization, all states vary in the content,procedure and means of collective bargaining. However, the two parties of collective bargaining must abided by the constitutions and laws of federation and states.
