摘要
居住权作为一种重要的制度,首次规定于2004年10月人大法工委通过的物权法草案中。这一制度源于罗马法的居住权制度,作者对此进行了阐释。作者对居住权制度的身份性和保障功能进行了澄清和并提出了新的构想。
The right of residence was established in the draft of real fight law passed in October, 2004 by the Legislation Committee of National people＇s Congress. It comes from the Roman law of the fight of residence. The paper gives the explanation to the status and guarantee functions and puts forward some new suggestions.
