浅析我国企业商业秘密的法律保护

Brief Discussion on the Protection on Enterprise Business Secret in China

本文从我国在世界贸易组织背景下,对企业商业秘密的概念、范围、分类和法律特征等进行了分析,论述了国际商业秘密保护现状和我国商业秘密立法状况的发展及其对我国企业管理等方面的影响,并对我国商业秘密保护与TRIPS相比的不足之处进行了探讨。最后,本文对我国企业商业秘密保护和我国商业秘密侵权救济制度的完善提出了一些建议。

This paper starts from the background of our country entry into World Trade Organization. It analyzes conception, areas, classifications, legal characteristics of business secret in enterprise. It discusses status quo of business secret protection in the world and the development of business secret protection lawmaking in our country which have effects on enterprise management. It also discusses the differences of business secret protection between our country and TRIPS. At last, the paper makes a series of recommendations to improve the system to the protection of commercial secrets of our businesses and our commercial secrets infringement relief.
