城市化进程中农民土地权益的保护

The protection of peasants'land rights in the urbanization process

随着我国城市化进程的加快,大量的农地被征用,出现了大批的失地农民,因而引发了一定的社会矛盾和纠纷。如何在城市化过程中保障农民土地经营权不受侵害,笔者认为,应当从法律上界定农民土地权利的内涵和外延,从而根本性地提升土地承包经营权的法律地位。

With the increase of the urbanization process, large amounts of farm land was requisitioned, only to lead to many lost territory peasants, which triggered some social conflicts and land dispute. This paper believes that we should define the intension and extension of peasants＇ land rights to have a radical increase the legal position of the right of the management of contracted land. As a result, peasants＇ management of land can be protected from infringing.
