摘要
探寻文义解释的悠久历史和含义演变,以海事审判实践中的实例表明其仍然是法律解释的基本方法,并根据哲学解释学理论的观点,分析其在语言哲学上受到的批评和局限,提出完善文义解释的途径和措施。
Exploring the centuries-old history and its evolvement of literal interpretation, the paper pointed out that it is the essential method of legal interpretation by offering some examples in the marine judgement practice. Then it probed into some criticism and limits through the viewpoints of the philosophy hermeneutic,and put forward the approaches and measures of how to make it more perfect.
