摘要
预售商品房的再转让是市场经济的产物,从法律的角度来讲其实质就是合同权利义务的转移,不能因为再转让可能会带来的负面效应而全盘否定这一合法、合理的市场行为。文章中作者从合理性和合法性两个角度论证了预售商品房再转让的可能性,同时还对预售商品房再转让过程中应当把握的条件、再转让的程序和相关责任进行了分析。
The transfer of commodity house presell is the outcome of market economy and thinking from law it is the transference of the contract rights and obligations in fact, so we can' t completely negate the legal and reasonable market action just because it maybe brings some negative affects. In the article the author demonstrates the possibility of transferential commodity house presell from the two points of validity and rationality, in the meantime the author also analyses the conditions, the transferential procedurere and correlative duty in the procedure of the transfer of commodity house presell.
