我国工程总分包管理制度的若干缺陷及完善建议

Defect and Countermeasures of General Contract and Subcontracting Management System in China

围绕我国工程总分包管理制度存在的缺陷,分析了我国现行分包体系在资质管理制度上的不足并提出了完善建议,对“主体结构施工应当由施工总承包单位自行完成”展开论述,提出应当正式确立内部承包经营制的法律地位,完善违法分包、转包和挂靠的法律责任,对如何加强指定分包管理制度建设提出建议。

According to some defects existing in the subcontracting management institution in China, the paper analyses the contradictions between the qualification regulations and the current subcontracting system, and puts forward some proposals. And then, the paper discusses the important issue on ＂main body structure should be carried out by the general contractor＂, and suggests that the legal position of internal contracting system should be set up and the legal liabilities for illegal subcontracting should be adjusted reasonably. Finally, some proposals on how to strengthen the nominated subcontracting institution has been put forward.
