依据刑法问题类型划分的方法,我国刑法学中有关犯罪构成中构成要件排列顺序的四种观点是分别在刑法学问题即解释选择问题的意义上和刑法问题即司法技术问题的意义上被讨论的。从刑法问题类型的划分上来看,犯罪构成中构成要件的排列顺序问题属于司法技术问题,因此,犯罪构成中构成要件的排列顺序应该以是否有利于司法实践中对于犯罪的认定为主要标准。

According to the method of defining criminal issues, the four views in the sequence of constitution factors for crime in criminal law of China are discussed in the dimension of choice of interpretation and judicial technology. By the view of definition of types of criminal issues, the sequence of constitution factors for crime belongs to issues of judicial technology. Therefore, the sequence of constitution factors for crime should be queued by the criteria of finding crimes in judicial practice.
