International Protection of Women’s Rights: Problems and Transform

妇女权利属于人权的范畴,而非追求妇女的特权。以联合国为主导的国际组织为推进妇女人权做出了重要贡献,其中CEDAW是核心文件。CEDAW的任择议定书以及区域性的法律机制同样有助于保护妇女人权。然而,CEDAW所建立的报告机制以及CEDAW任择议定书的来文机制都存在着执行上的障碍。为解决这些问题,有必要建立以人为本的国际法治理念,要求国家以真诚的态度保护人权,并进而整合人权的监督机构,重视非政府组织在提升人权方面的作用。

Women’s rights are a category of human rights instead of women＇s privilege. The universal protection mechanism of women＇s rights begins by the United Nations among which CEDAW is most important. The optional protocol to CEDAW, as well as regional legal institu- tions also achieve to the protection of women＇s rights. However, the report system of CEDAW, and the Communications Procedure of the optional protocol, operates with many obstacles. To solve the problems, the idea of international rule of law based on human should be established, states should protect human rights honestly, institutions for human rights should be integrated, and the function of NGOs should be stressed.
