无单放货给各方当事人带来诸多不便,“仅供议付提单”似乎能解决目的港“货到单未到”的矛盾。“仅供议付提单”名为提单,其实并不是真正意义上的提单。“仅供议付提单”并不会在将来取代传统提单。与传统提单相比,当事人在其中的法律地位将发生巨大变化。我国出口企业使用“仅供议付提单,”实质上使自己处于十分不利的地位,实在有必要采取合理的应对措施。

Inconvenience is brought to any party due to cargo passing without bill of lading. Bill of lading marked ＇only for negotiation＇ can somewhat resolve the contradiction of cargo delivered at destination port with bill of lading not reached. The so-called bill of lading marked ＇only for negotiation＇ is actually not a bill of lading in a real sense. It will not take the place of bill of lading in the future. Comparing the bill of lading, the legal status of the party under the bill of lading marked ＇only for negotiation＇ will be greatly changed. The Chinese exporters have put themselves at a disadvantage by accepting bill of lading marked ＇only for negotiation＇ . It＇ s quite necessary for them to take some effective measures to improve their legal status.
