论中国跨国银行监管法制的完善——新修订之《外资银行管理条例》评析

The Perfection of Supervisory System of Multinational Banks of China——Analysis of Regulations of the People′s Republic of China on Administration of Foreign-funded Banks

跨国银行监管主要包括准入监管和经营监管,前者主要体现为进入形式和条件的限制,而后者更多地强调管制措施和风险管理两方面。新出台的《外资银行管理条例》及其实施细则对准入监管和经营监管都做了较为详细的规定,但还存在着诸多缺陷。因此,需要借鉴国外及国际跨国银行监管的有益规则和先进做法,进一步健全和完善我国的跨国银行监管法制。

The supervisory system of multinational banks is composed of entry restriction The Regulations of the People＇s Republic of China on Administration of Foreign-funded and operation restriction. Banks has some detailed rules on them, but there still exist many defects. Following the lead of other countries＇ successful legislation and advanced implementation, the supervisory system of multinational banks of China should be reconsidered and perfected.
