根据香港《基本法》第43条、59条及60条的规定,香港特区行政长官是香港特区和特区行政机关(政府)的首长。行政长官的法律地位具有两重身份,特区首长的身份表明其法律地位高于行政、立法和司法机关;与其法律地位相适应,行政长官具有相当广泛的权力。
Articles 43, 59 and 60 of the Basic Law of the Hong Kong Special Administrative Region (HKSAR) provide that the chief executive of the HKSAR shall be the head of the HKSAR and shall represent the region; that the head of the government of the HKSAR shall be the chief executive of the region; that the chief executive is of a dual legal status; that the identity of the chief executive indicates that his legal status is above the administration, the legislature and the judicial power; and that the chief executive has a very broad range of power that is compatible with his legal status.
