摘要
为了全面、深入地理解诉讼中的真实,运用了归纳对比的方法,梳理了对诉讼真实产生重要影响的哲学上的真理理论:符合论、融贯论、实用论和马克思主义真理论;通过对几个关键问题不同观点的辨析,阐释了诉讼中的真实与哲学中的真理的关系,并根据不同的标准对诉讼中的真实进行了分类。研究结果表明,马克思主义的真理理论是我国诉讼真实论的理论指导;在诉讼中,出于发现真实、保障人权、程序正义、诉讼效率等多元价值的考虑,应当坚持客观真实与法律真实相结合。
In order to understand litigation truth widely and deeply, through induction and comparison, different truth theories are introduced （ correspondence theory of truth, coherence theory of truth, pragmatic theory of truth and Marx＇ s theory of truth） which exert different influence on litigation truth and comment different opinions on litigation truth. Through differentiating and analyzing several key problems, the relationship between litigation truth and philosophy truth are explained. Litigation truth can be classified according to different standard. As conclusion, Marx＇ s theory of truth is theoretical base of litigation truth in China; finding fact, protecting human rights, due process, effectiveness of proceedings and so on should be considered, objective truth （ substantial truth） should be combined with legal truth.
