网络远程教育的立法必要性与立法依据

On the Necessity and Foundations of the Legislation on Networked Distance Education

近年来,我国网络远程教育呈现出蓬勃发展的势头,但由于立法上的缺失,面临着许多矛盾和发展性问题。为了保障网络远程教育的健康、持续发展,加快网络远程教育的立法尤为重要。在制定网络远程教育法中,不仅要贯彻平等教育、终身教育的理念,以我国《宪法》和《教育法》为法律依据,还要坚持实事求是的原则,借鉴国外网络远程教育的立法经验,制定出符合我国实情的网络远程教育法。

In recent years,networked distance education(NDE)develops rapidly,but it is also faced with many difficulties caused by the vacancy of relevant legislation,which is indispensable for the healthy and continuous development of NDE.During the distance education legislation process,we should stick to such core notions as educational equality and life-long learning,base the law on our Constitution and Education Law and stick to the principal of ″seek truth from facts″.
