论公安行政损害赔偿范围的立法缺陷及完善

On the Legislative Imperfection and Its Perfection of Police Compensation Extent of Administrative Damage

对于作为要求国家承担赔偿责任的公安行政损害赔偿范围的确定,法律规定还不够完善,从而损害了行政相对人的合法权益。文章从我国公安行政损害赔偿的范围、公安行政损害赔偿的范围的影响因素和界定原则、我国公安行政损害赔偿范围的立法缺陷及调整我国公安行政损害赔偿范围的建议等四部分,对我国行政损害赔偿的范围问题进行了探讨。

The legal stipulation is yet to be perfected as to the determination of compensation extent for the damages caused by public security administration, which should be undertaken by the state. This paper probes into the problems of the compensation extent of administrative damage, including the compensation extent, factors influencing it and principles for its delineation, its legislative imperfection in China and proposals for its regulation.
