中日法学研究方法与视角比较分析

Comparative Analysis on Methods and Perspective of Sino-Japanese Jurisprudential Study

中日两国法学研究方法与视角存在明显的不同,具体表现在哲学与法学理论基础、主体意识、问题意识与理论模型构建三方面。通过对上述三方面不同的比较分析,可以看出当前中国法学研究中存在的理论基础、主体意识和问题意识缺失的现状,并能对我国的法学理论研究产生一定的借鉴意义。

There are obviously differences in the methods and perspective of sino- Japanese jurisprudential study. It shows concretely as follows：the theoretical foundation of philosophy and law,the subject consciousness,the consciousness of problems and construction theoretical mode. Based on the comparative analysis on above three differences, we can see the current situation of Chinese jurisprudential study： the theoretical foundation, the subject consciousness and the consciousness of problems are absent, and we hope it can provide certain experiences for Chinese jurisprudential study.
