The Unification Principle on the Right and the Duty of the Law Relationship

伴随着现代文明的高度发展,社会个体越来越重视权利的享受。权利与义务是基于利益分配关系基础上的社会关系范畴,是社会主体在特定社会条件下,按照“公正”的社会道德和法律规范,应当采取某种行为或不发生行为的社会意识和社会制度。为了摆脱权利与义务的相统一原则传统的误区,还给世人一个真实的权利和义务的面目,须厘清权利与义务及二者的关系。

With the rapid development of modem civilization, social individuals value the possession of the right more and more. Right and duty are the social relation categories based on the benefits distribution. Under particular social condition and according to the ＂fair＂ social morals and the law norms, right and duty are social consciousness and social system in which the social individual should adopt a certain behavior or should not. To get away from the traditional mistaken area of right and duty unification,we should make clear the right, duty and relationship of them.
