摘要
2005年新修订的公司法对“公司社会责任”仅作了一般性规定,然而对其法律属性的探讨还有待深化。基于法理学和法解释学的视角,可以发现其作为公司法原则的实质,而其实现机制的建立必须依靠多个法律部门的协调配合。
The new modified company law makes a general provision of "corporate social responsibility" ,but the study of its legal nature is not enough. Based on perspective of jurisprudence and law hermeneutics, we can find that corporate social responsibility is the principle of the company law and the foundation of its realization mechanism must depends on the coordination of interrelated law organs.
