土地承包经营权流转的核心价值有二,一是建立城乡统一的劳动力市场,二是实现农业现代化。土地承包经营权的转让及流转的登记对抗主义模式有利于上述核心价值的实现,《农村土地承包法》应予坚持。土地承包经营权的抵押有利于上述核心价值的实现,《农村土地承包法》在修改时应予明确规定。而土地承包经营权的转入人应具有农业经营能力,土地承包经营权转让应经发包方同意,不利于上述核心价值的实现,《农村土地承包法》在修改时应予摈弃。

The core values of the circulation of the right to contract for management of land lie in the building of integrated labor market and the accomplishing of the modernization of agriculture. The transference and mortgage of the right to contract are beneficial to realize the two values, thus should be provided in Real Right Law. However, the clause that the assignee must be capable of agriculture and the transference of the right should be granted by the contractee is not beneficial to accomplish the two values, thus should be abolished in Real Right Law.
