The Application of Consumer's Protection Law for Hospital-Patient Relationship——The Analysis on the Basis of Patients'Rights

当前,医患关系日益紧张,医疗纠纷不断发生,其中不乏侵害病人权利的事件。对病人权利的侵害,不仅损害了大众的利益,而且也危害到正常的社会秩序。那么,对病人权利的保护就显得尤为重要。本文即以病人权利为中心,从病人权利运动的历史发展、病人权利与消费者权利的现实比照及病人权利的实现问题三个层面论证《消法》对医患关系的适用。

Currently, the hospital-patient relationship becomes more and more tense and medical conflicts occur constantly, in which things infringing on patients＇ rights usually take place. These things not only damage the common goods, but also do harm to the order of the society. Then, it is very important to protect the patients＇ rights. This paper demonstrates that consumer＇ s protection law applies to hospital-patient relationship by a close analysis of the patients＇ rights. It comprises three parts, which are the history of the movement of patients＇ rights, comparing the rights of patients and consumers, and the issue of implementing on patients＇ rights.
